Frequently Asked Questions

  1. Do I have to pay you in advance to represent me in my personal injury case?

No. Isaacs Law Office works on a contingency fee basis for serious personal injury and wrongful death cases. We advance all case expenses in personal injury or wrongful death cases. At the end of the case, we will deduct from the jury award or settlement our contingency fee and the case expenses we advanced.  If in the event we are unable to collect any money from the at-fault party, you will not owe us anything.

  2. I was seriously injured in a car accident which was not my fault. Who pays my medical bills?

Regardless of who is at fault, according to Kentucky’s personal injury law, the insurance company for the vehicle you were in will pay your medical bills and a percentage of your lost wages up to your policy limit.  They do this according to the personal injury protection (PIP) clause of the vehicle insurance policy. Under Kentucky law, PIP coverage is typically $10,000, but may be more if the vehicle owner purchased additional coverage. If the total medical bills exceed the amount of available PIP, then you can optionally authorize Isaacs Law Office to compensate your doctors from any recovery received from the at-fault driver's bodily injury coverage or your uninsured / underinsured policy.

  3. Should I hire an attorney to handle my car accident case?

After working as an attorney for many years, I am of the opinion that every injured person should have an experienced personal injury lawyer handle their case. The laws are complex and it is easy for non-lawyers to make mistakes which can affect the amount of compensation you may be entitled to receive.  Additionally, insurance companies use techniques to minimize the amounts they pay out to settle personal injury cases. I have learned of settlements accepted by unrepresented individuals for less than the net amount Isaacs Law Office has obtained for our clients for similar injuries. Isaacs Law Office provides free consultations for seriously injured people so that they can learn their rights if they were injured by the negligence of another person.

  4. How much is my personal injury case worth?

There exists no formula for calculating what a case may be worth. Many factors are used to determine the value of your case: some factors are definite and easily calculated while others are not. The definite factors include past lost wages and the cost of your actual medical bills. The indefinite factors include: future medical bills; prior injuries and their impact on current injuries; prior accidents; future lost wages; pain; suffering; impairment; and the severity of your permanent injuries sustained. Additional factors which will affect the value of your case include: the type of medical treatment received (i.e.: medical doctor versus chiropractic); the length of treatment; whether the treament received was reasonable and necessary to treat your injuries suffered in the accident; whether your medical provider(s) will cooperate to help you recover your economic damages; and the amount of available insurance coverage.

  5. Do you offer free consultations to discuss the representation of my criminal case?

Over the years, we learned that we can offer lower legal fees to defend persons charged with committing crimes if we did not offer free consults. However, we believe the law should be affordable and that everybody should initially have access to a lawyer. We therefore offer to discuss the defense of a criminal case with the accused person in an initial consultation for a one-time only reduced fee.
